One Injured in Suspected Drunk Driving Accident on Main and Austin Street in Brownwood, Texas


BROWNWOOD, TX — A two-vehicle accident left one driver in the hospital in Brownwood, Texas on Thursday, July 10th, 2014, according to a news report from Brownwood News.

Police say that they believe one person was hurt when a Chevy Caprice is thought to have failed to yield to a pickup truck while driving near the intersection of Main and Austin Street sometime Thursday night.

The offending driver was taken by paramedics to Brownwood Regional Medical Center where he was being treated for unspecified injuries.

Investigators are working to determine if alcohol played a role in the crash.

The investigation is currently being handled by Brownwood Police.

Commentary:

If this person came from a bar, there is a very real possibility there could be a claim against the establishment for their involvement in the crash. How is this possible? Well, the State of Texas is lucky enough to have first party liquor liability, and when somebody injures themselves after being irresponsibly served, they can make what is called a ‘first party dram shop claim’ against the bar. If this driver was served too much to drink, outside regulations limit, then the bar could face some of the liability in this case.

I was actually a couple cars back from this wreck, one of the first on the scene, and helped administer CPR on the victims. The truck driver was going way too fast, but it was actually his trailer that swung around and hit the suv, the semi-truck ended in the median.
