Commentary:
Just looking at this news release tells me that this accident could probably go one of two ways. Either the truck that pulled off the shoulder and caused the victim to swerve could be at fault, depending on the reasons he was in the shoulder, and if he was paying attention at the time of the accident. If the trucker failed to check his mirror, a mistake all of us make at some point or another, and caused this accident, the trucking company could be liable. On the other hand, if the truck’s load shifted, the company responsible for securing the cargo could be at fault. Either way, this is one of the accidents that definitely deserves a closer look.
