Commentary:
In the event you ever find yourself in an accident like this one, knowing how fault is decided could give you an edge over anybody else involved. In the State of Texas, we use a system of contributory negligence, otherwise known as ‘comparative fault’ where a jury is given all the facts and evidence surrounding an accident, and the jury does their best to take the guesswork out of the hands of accident investigators and victims locked in a he-said-she-said conundrum. This is where an independent accident investigation can shift the tide of a case, and add to the evidence that could have otherwise been incomplete or incorrect. For the majority of people finding the truth behind what happened is the most important, which can reveal who was truly responsible for an accident.
