Commentary

I’m no expert, but it doesn’t seem to me as if a crane this large being toppled by something like a clam dredge is a thing that’s supposed to happen. It’s actually really surprising. To be honest, I have to wonder if there was something wrong with the crane that could have caused it to roll over. Typically, accidents like this these happen on the job, and are therefore going to be covered by an injured employee’s workers’ comp policy. There is an exception to this, however, and that’s if a third party was in some way involved. The employer/employee workers’ comp agreement doesn’t extend to third parties. So that means that if something were wrong with the crane, let’s say, then the injured employee would have every right in the world to file a claim against the crane manufacturer, or perhaps whoever was responsible for its maintenance, just as if they were out on the road, and someone had hit them with their car. Hopefully this is something the police investigation will be able to shed some light on.
