School buses are one of several vehicles that typically enjoy sovereign immunity when it comes to accidents like this one. In Texas, lawmakers passed the Texas Tort Claims act which will allow people to hold government entities responsible whenever something like this happens. Obviously, the TTCA won’t apply anywhere outside of Texas, so those involved in these accidents will want to check to see what the law says in their own state.
Beyond that, I think the bus driver involved here has some questions he needs to answer. Why did he pull out in the middle of traffic in the first place? Obviously, the victims’ vehicle wasn’t too far away at the time. Why didn’t he see them? Was he paying proper attention to the road? This accident wasn’t nearly as bad as it could have been. However, people who driver children around full time have to be held to a higher standard. If this driver can’t be trusted to do his job, maybe he shouldn’t be doing his job.
