Unfortunately, accidents like this one happen all the time. But not all of the drivers responsible for them are ticketed by police. It’s important for people to remember that, as far as the law is concerned, a cop ticketing or charging a driver for an accident is a completely different matter than the claim a victim has a right to file against the same driver. One is a criminal matter, while the other is a civil matter. Many people think that a civil claim can get in the way of a criminal claim making its way through the system. This isn’t true, and it’s sometimes the case that those handling a civil case find evidence that can bolster a criminal case. Having two claims against the same driver at the same time isn’t something that should worry victims of these types of accidents.
