Commentary
Although it’s possible for an accident like this to be caused by a defective automobile, they’re very often caused by driver inattention. If that turns out to be the case here, then the driver will very likely be held responsible for his passenger’s injuries. Drivers owe their passengers a duty of care and if a passenger is injured because of a driver’s actions, the driver can be held accountable for it.
