Commentary
Figuring out liability in an accident like this is pretty easy. However, it can be difficult for those involved in the accident, because regardless of many were injured, a typical auto insurance policy is only ever so big. And when medical bills are concerned, most know that money has a way of disappearing very, very quickly. This can create a bit of a mad dash to the courthouse, with everyone injured jockeying for the first spot in line.
Unfortunately, accidents like this can be even more difficult, as the person at fault for the crash has no evidence that she is, in fact, insured. In these cases, those who cause accidents can open themselves up to lawsuits in which certain assets can potentially become a target. Another possibility is that the transit company has a UIM policy, which stands for uninsured motorist. A UIM policy is something that an entity — typically a business — will pay a premium for that will “cover the gap” that another’s party won’t cover. Those policy’s could also cover injuries, but doesn’t pay out automatically. Unfortunately, that’s something that those involved in these sorts of accidents have to seek out.
