Commentary:
Many would assume that just because the worker was on the job at the time of the accident, that they will be corralled into a workers’ compensation solution, but things are usually far more complicated than that. If this worker was a contractor, and many that work on gas lines are, then the claim would not be against their employer, but would be against the company who contracted them. If the worker was a contractor, their claim would be viewed no differently than if the victim was a jogger running by the scene when the explosion happened, and usually yields far more beneficial outcomes than the alternative. Just because somebody was at work when they were hurt, does not mean that they are relegated strictly to workers’ compensation, depending on the circumstances.
