Commentary
While these sorts of things can be looked on as accidents, they can also be looked on as avoidable in certain instances. Anyone reading about this accident is going to chalk up its tragic outcome to the weather. There’s some truth to that, however, the weather is not a very reliable defense in these situations. Drivers have to adjust their driving accordingly whenever the roads are in these sorts of conditions. One can make the argument that the victim was not driving safely, but when he crashed, no one was injured. The exact same thing happened with the second driver, however, someone was injured and lost their life in his accident. There’s liability there. How fast was he driving? Was he driving too fast? While some may look at these kinds of accidents as being unavoidable, a great number of them can be avoided. And if this accident was avoidable, there’s going to be some liability there on the part of the second driver.
