Commentary
Obviously, our first question about something like this is going to be, how did the accident happen? Reports say that a piece of framework fell over. Why did that happen? Was the work just incorrectly done? Did a piece of equipment fail? As far as who’s responsible for the accident, or for how it’s handled, that really depends on who was hurt. It’s possible that this will be entirely covered by the victims’ employer’s workers’ comp policy. It’s also possible that another company working on the premises had something to do with the accident, and the victims could have a claim against them. None of this will be clear until more information comes out. That’s why the investigation following an accident like this is always so important, and why victims could do a lot worse to commission an independently-run investigation to handle things. These types of investigations typically run much faster than anything OSHA does, and not only can tell a victim how an accident happened, but why it happened, which can be very important in determining liability.
