Della Foust Killed in Alleged DUI Accident on Highway 297 in Newcomb, TN


Newcomb, TN — One person was killed and two were injured in an accident that police believe was caused by alcohol. The accident took place in Newcomb, Tennessee, on Wednesday, March 11, 2015.

According to local sources, the accident happened when Michael Kidd was headed south on Little Elk Creek Road and tried making a left-hand turn to head east on Highway 297. A Dodge Ram being driven by Buford Trammell failed to yield and crashed head-on into the Jeep.

Della Foust was a passenger in one of the vehicles and killed in the crash. Reports do not make clear which vehicle she was driving in. Kidd and Trammell were both injured. The full extent of their injuries is unknown.

Officials say that none of the three were wearing seat belts at the time.

The accident is still being investigated, and officials say that alcohol was involved in the crash and that criminal charges are pending.

Commentary

If alcohol was involved, as police believe, it’s possible that a bar could be held partially responsible for the accident. Tennessee has what are known as dram shop law, which forbid establishments that serve alcohol to serving customers who are visibly intoxicated. The reasons for such laws should be pretty obvious. The more alcohol someone consumes, the greater chance they have of getting into an accident. If someone in this accident was drinking, was over-served, and then went out and got into an accident, that bar could be held partially liable for the crash. Unfortunately, too many bars out there ignore these laws, and instead open their doors the next day as if they’ve done nothing wrong. These people need to be held responsible for their actions.
