Garden Grove, CA — The driver of a tow truck was hospitalized after being hit by a car in Garden Grove, California, on Monday, March 9, 2015. The accident took place on Highway 22, near the Knott exit.
According to local reports, a woman had stopped on the side of the road and a tow truck was assisting. The driver of the truck had gotten out of his vehicle and was in the process of moving the woman’s vehicle onto the back of his truck.
The driver had leaned into the vehicle to help the driver with something when a Lexus came up behind them and crashed into the back of the vehicle. The tow truck driver was thrown through the air and taken to a local hospital.
Both vehicles involved in the accident rolled onto their sides following the collision.
Police have not cited any of the drivers.

This accident happened in the middle of the afternoon, on a clear stretch of highway. There’s no reason the driver of the vehicle responsible for the accident shouldn’t have been able to see what was in front of him and slow down or change lanes. If the accident happened because the driver just wasn’t paying attention, then they can be held liable for the accident, regardless of whether or not they’re cited by police. As things stand now for the tow truck driver, it seems as if he would have a claim against the driver responsible for the crash, as well as being eligible for workers’ comp benefits.
