Quincy, MA — A 12-year old boy was hospitalized with serious injuries after being hit by a taxi in Quincy, Massachusetts, on Monday, February 23, 2015. The accident took place on Berlin Street, around 3:00 in the afternoon.
Police said the boy was one of three walking in the street as they made their way home. The boys said that they were walking in the street because there was so much snow on the sidewalks.

Police are currently investigating the accident. The taxi driver has not yet been charged.

Commentary
I think a lot of people might look at this accident and say that the boys shouldn’t have been walking in the road. There may be some merit to that argument. However, the fact that they were in the road wouldn’t give any driver the right to completely disregard them as they were driving by. Drivers have an obligation to avoid accidents whenever possible. Regardless of who was in the wrong. If it’s found that this accident happened because the driver wasn’t paying close enough attention to the road, it’s possible that he could at least partially liable for it.
