Commentary:
Taking a step back from this accident, and looking at it from a passenger’s point of view in any accident, there are some things that people really need to understand. As a passenger, you typically have zero control as to how the vehicle is steered or operated in general. You are, quite literally, along for the ride. So when the driver does something like take faulty or dangerous evasive maneuvers to avoid an accident, but causes one anyways, the passenger usually bears no fault, and would more than likely have a claim against the driver’s policy depending on what actually happened.
