Armstrong County, PA — A student was hospitalized for an injury sustained in a school bus accident in Armstrong County, Pennsylvania, on Wednesday, February 18, 2015. The accident took place on Route 422, around 3:00 in the afternoon.

The school bus had stopped to let off a student. Conditions on the road were very icy. Reports say that a snow squall was moving through the area, and visibility was near zero. While the bus was stopped, it was hit from behind by a dump truck.

Of fifteen students on the bus at the time of the accident, one was cut above the eye and taken to the hospital by ambulance.

The driver of the dump truck wasn’t identified.

Commentary

There are several things to take into account when trying to determine liability in an accident like this. The weather is something that should be considered, but doesn’t tend to work very well as a defense because a driver has a responsibility to adapt to the conditions on the road. If a driver can’t see the road in front of him, he shouldn’t be driving. Other things to be taken into consideration are who owns the truck. If it’s owned by a private company, then filing a claim would be similar to any other accident. If the truck were owned by the city, victims will typically have a few more hoops to jump through, as filing a claim against a municipal entity is much more difficult.

I'm a former employee. I had brought up this exact scenario and suggested a maintenance procedure that would eliminate the possibility of this type injury. Obviously my warning went unheeded.

I was actually a couple cars back from this wreck, one of the first on the scene, and helped administer CPR on the victims. The truck driver was going way too fast, but it was actually his trailer that swung around and hit the suv, the semi-truck ended in the median.

A lot of people say smack about lawyers, but I want to say that I'm glad there is a way that people who are wronged by corporate neglect can get justice and force change. We are living in a world where corporations and govt care less than ever about common people, and I support your work. I hope I will never need your services.

Thank you for posting these accident articles on your site. At the company that I work for, e deal with monitoring construction activity and work around trenches and all sorts of construction equipment/vehicles. I sometimes wonder if construction companies have enough safety training to inform employees of how to protect themselves while on the job.
