Commentary
I have to wonder if a bar was involved in this accident. In other states, bars are forbidden to sell alcohol to those who are obviously intoxicated. If a person is over-served, and then goes out and gets into an accident, the bar can be held liable for it. And rightly so. If a bar refuses to cut someone off when they’ve obviously had enough to drink, and then that person goes out and gets into an accident, they should be held accountable for that. Unfortunately, Virginia doesn’t have those protections in place. Every time I see an accident like this I have to wonder if it could have been avoided if those protections were there.
