Dog Attack in McKinney, TX Neighborhood Injures Mother, 2 Children


McKinney, TX — The news reported a dog attack last week in a McKinney neighborhood off Eldorado. This happened last Thursday (February 5, 2015), when a mother and her two young daughters all had to be taken to a hospital after a pit bull dog attacked them.

This happened at the victims’ home, which is in a local neighborhood. According to the news, the family was “petsitting” the dog that Thursday and this happened when one of the daughters was outside with the dog.

The police said that the girl yelled and was found with the dog in the front yard, having been bitten. Officers arrived at the scene and were forced to shoot the dog to stop the attack. The mother and her two daughters were taken to a hospital. The news said that the dog had attacked one of the daughters and the mother, while the other young girl was injured while trying to escape the dog.

More details will be released later. It’s not clear who owned the dog.

Commentary:

A lot of people aren’t familiar with how the law works in situations like this, but Texas has what’s commonly known as the “One Bite Rule.” That means that, essentially, animals are allowed one “free” bite or attack before their owner is considered responsible. Under normal circumstances, if an animal has no history of violence or aggression, then the law would look upon the first attack or bite as a one-time occurrence.

Of course, the dog in this instance had to be shot, which tells me that the attack was a little more serious than most. Does that mean that the owners should be held liable, even if it’s the first attack? That’s a question I can’t answer without knowing more information, but I can’t help wondering if this dog had any kind of history that should have concerned anyone.

I was actually a couple cars back from this wreck, one of the first on the scene, and helped administer CPR on the victims. The truck driver was going way too fast, but it was actually his trailer that swung around and hit the suv, the semi-truck ended in the median.
