Commentary:
With accidents that involve passengers, the passengers and drivers usually have some kind of relationship, so things can get a little sensitive. Because of this, I think looking at this accident through a strictly clinical, legal eye may help people understand passenger rights a little better. Now, barring a passenger grabbing the steering wheel or interfering with the operation of the vehicle in any way, passengers rarely, if every bear fault in an accident. In reality, drivers have a duty of care to ensure they will drive in a manner that will leave their passengers, and anybody else on the road unharmed. Any failure to do this probably means that the driver is at fault.
