Rosenberg, TX — A daycare worker in Rosenberg, Texas, after a co-worker alleged that she saw the 54-year old woman kicking a sleeping two-year old.

According to local sources, the woman — identified as Sandra Petrosky Cernoch — kicked a two-year old multiple times while he was napping, which reportedly resulted in bruises on the child.

A co-worker saw Cernoch kicking the child, and told the head of the daycare about the incident, who then told local police. Police arrested Cernoch and took her to the Fort Bend County Sheriff’s Office. Her bail has been set at $15,000.

Police are currently investigating the accident.

Commentary

This sort of behavior is absolutely disgusting and this woman needs to be held accountable for it. Working mothers and fathers place such a huge amount of trust in daycare workers when they leave their children in their care every day for months or years on end, and I can only imagine how difficult it would be bounce from something like this. Basically have to relearn how to trust someone with your child.

As for the legal side of this, many people in Texas believe that a claim can only be brought against a person in the case of negligence, which means that an at-fault party failed to take the care needed to fulfill a duty owed. But claims can also be brought against an at-fault party for what’s known as an intentional tort. An intentional tort is when a wrong results from something that an at-fault party has intentionally done. I’m going to go ahead and say that this woman is going to have a hard time making the case that she kicked a two-year old over and over again on accident. I’ll say again, hopefully she’s held responsible for what she’s done. Fortunately, she’s been let go by her now-former employer. A person like this really shouldn’t be allowed around children.

I'm a former employee. I had brought up this exact scenario and suggested a maintenance procedure that would eliminate the possibility of this type injury. Obviously my warning went unheeded.

I was actually a couple cars back from this wreck, one of the first on the scene, and helped administer CPR on the victims. The truck driver was going way too fast, but it was actually his trailer that swung around and hit the suv, the semi-truck ended in the median.

A lot of people say smack about lawyers, but I want to say that I'm glad there is a way that people who are wronged by corporate neglect can get justice and force change. We are living in a world where corporations and govt care less than ever about common people, and I support your work. I hope I will never need your services.

Thank you for posting these accident articles on your site. At the company that I work for, e deal with monitoring construction activity and work around trenches and all sorts of construction equipment/vehicles. I sometimes wonder if construction companies have enough safety training to inform employees of how to protect themselves while on the job.
