Commentary:
A lot of how this accident is going to be handled rests on the machine involved in the accident. Was there some kind of problem or defect with the design, construction, or installation that led to this accident? Was the machine supposed to be operating while somebody was clearing a jam? If the hopper in this machine had some kind of defect, the victim may not be shoehorned into a workers’ compensation solution, instead, there may be a claim against the manufacturer of the machine. We call these factors third intervening parties, which tend to remove any need for draconian workers’ compensation resolutions, and all their painful disadvantages.
