Lubbock, TX — A pickup truck driver was hospitalized after an accident with a waste truck in Lubbock, Texas, on Monday, January 26, 2015. The accident happened at the intersection of farm to market roads 1729 and 2528, around 12:45 in the afternoon.
Police identified 38-year old David Benham as the driver of the pickup. Benham was headed west when he failed to yield to a waste truck at the intersection. FM 1729 has a stop sign at the intersection, while FM 2528 does not.
Benham suffered serious injuries and was taken to University Medical Center.
The driver of the waste truck, identified as Miguel Cervantes, sustained minor injuries and was treated at the scene.
Police are currently investigating the accident.

There are times in which accidents like this happen, and a driver has no time to react. The justice system understands this fact and makes allowances for it. However, there are also times in which the driver does have time to react and doesn’t do anything about it. Why? Maybe he’s not paying attention to the road. There are several reasons. The point is, for these accidents, the driver can be held liable for the accident, regardless of whether or not the other vehicle was in the wrong. Being right doesn’t give a driver the right to crash into others just because.
