Commentary:
Considering both the news reports, and photos of the scene clearly illustrate that a flatbed tractor-trailer struck the rear of one of the cars, this accident is probably going to be on the shoulders of the company behind the flatbed. Rear end accidents typically fall on the rear driver for two reasons. Either the truck driver ignored his training, and followed the victim’s car too closely, not giving himself enough room in the event of a sudden stop. Either that, or he was just good old fashioned speeding. In any case, depending on how the rest of the accident unfolded, I can’t imagine too many scenarios where the tractor-trailer wouldn’t bear a significant portion of the liability here.
