Commentary:

While the news did not explicitly mention it, given the facts reported in the news, I don’t really think it is too outlandish to suggest alcohol may have been a factor in this accident. If my suspicions are correct, and the driver is found to have been intoxicated, then what can be done? Well, first of all, charges against the driver will obviously be warranted, but is that where everything stops? Absolutely not. If you dig a little deeper, you may find that the driver came from a bar or restaurant, where, despite having a liquor license, they were illegally sold alcohol. What do I mean? Well, any sale of alcohol to anyone who displays signs of intoxication is considered illegal in the eyes of the State of Texas. This is significant because it means that the bar is an accomplice to the drunk driver. If a bartender could have cut this driver off, and prevented this accident, but failed to because he wanted a few extra dollars on the bar tab, then the bar needs to be held civilly liable, while the driver deals with the criminal consequences.

I'm a former employee. I had brought up this exact scenario and suggested a maintenance procedure that would eliminate the possibility of this type injury. Obviously my warning went unheeded.

I was actually a couple cars back from this wreck, one of the first on the scene, and helped administer CPR on the victims. The truck driver was going way too fast, but it was actually his trailer that swung around and hit the suv, the semi-truck ended in the median.

A lot of people say smack about lawyers, but I want to say that I'm glad there is a way that people who are wronged by corporate neglect can get justice and force change. We are living in a world where corporations and govt care less than ever about common people, and I support your work. I hope I will never need your services.

Thank you for posting these accident articles on your site. At the company that I work for, e deal with monitoring construction activity and work around trenches and all sorts of construction equipment/vehicles. I sometimes wonder if construction companies have enough safety training to inform employees of how to protect themselves while on the job.
