Coach Van Accident in Gering, NE, Injures Two on Highway 71

Gering, NE — Two people were hospitalized in an accident that took place in Gering, Nebraska, on Friday, January 9, 2015. The accident happened at the intersection of Highway 71 and 7th Street, around 4:00 in the afternoon.

According to local reports, Shaun Fulk was driving a pickup truck and crashed into a Denver Coach van being driven by Donald Gibson and which was carrying an undetermined number of passengers. The force of the collision forced the van off the road and into a ditch while the truck rolled over.

Falk and his 3-month old daughter were not seriously injured. Two passengers inside the van were taken to Regional West Medical Center. Their names were not released. Police are still investigating.

Commentary

Accidents like this have the sometimes unfortunate effect of creating a mad dash to the courthouse, with everyone who’s been injured trying to be first in line. I don’t know exactly what happened in this accident, but in similar cases I’ve seen, the transportation company can also be held partially liable for an accident if it’s found that the driver could have avoided the crash but didn’t. Drivers of commercial vehicles have a higher duty of care than regular motorists, because they’re able to cause more damage with their vehicles, and are being entrusted with the lives of those they’re transporting. Again, I don’t know many of the specifics of this particular accident, so I’m only speaking to these sorts of accidents in general.

I was actually a couple cars back from this wreck, one of the first on the scene, and helped administer CPR on the victims. The truck driver was going way too fast, but it was actually his trailer that swung around and hit the suv, the semi-truck ended in the median.
