Commentary:

If the news reports about this accident turn out to be true, then more than likely, this accident is going to be on the shoulders of the truck and their lack of situational awareness. When any vehicle, especially a large commercial vehicle like a flatbed truck makes a lane change, they need to use their high-vantage point to look down the road and make sure the path they are about to occupy is clear of slowed or stopped traffic. If the truck driver failed to do this for whatever reason, be it using a cell phone, looking for directions on their GPS, or simply finishing breakfast, then the trucking company is probably going to be faulted for this accident, barring some major details missing or omitted from the news report.

But be warned, these trucking companies, even when they’re obviously at fault still wield nearly unlimited legal resources and decades of experience handling accidents on a monthly basis to fight off claims, no matter how valid. Even though the news article paints a pretty clear picture of fault, victims shouldn’t expect the trucking company to make things right without some legal arm-twisting.

I'm a former employee. I had brought up this exact scenario and suggested a maintenance procedure that would eliminate the possibility of this type injury. Obviously my warning went unheeded.

I was actually a couple cars back from this wreck, one of the first on the scene, and helped administer CPR on the victims. The truck driver was going way too fast, but it was actually his trailer that swung around and hit the suv, the semi-truck ended in the median.

A lot of people say smack about lawyers, but I want to say that I'm glad there is a way that people who are wronged by corporate neglect can get justice and force change. We are living in a world where corporations and govt care less than ever about common people, and I support your work. I hope I will never need your services.

Thank you for posting these accident articles on your site. At the company that I work for, e deal with monitoring construction activity and work around trenches and all sorts of construction equipment/vehicles. I sometimes wonder if construction companies have enough safety training to inform employees of how to protect themselves while on the job.
