UPDATE: Yvonne Lewis Killed in Car Accident in Asheville, North Carolina


ASHEVILLE, NC — Yvonne Lewis was killed in a car accident that happened in Asheville, North Carolina on Thursday, January 8th, 2015. The news articles about the accident say that the crash happened at about 7:45 Thursday morning.

67-year-old Yvonne Lewis died when she was struck by a passing motorist while she was walking along or trying to cross the street on Merrimon Road. Authorities said that the Audi struck Lewis in the southbound lanes.

Lewis was pronounced dead after being taken to Mission Hospital.

The driver of the vehicle was immediately unhurt in the accident.

Asheville Police are still investigating the accident.

Commentary:

As with the vast majority of pedestrian accidents, fault is almost always going to depend heavily on the placement of the victim in the road when they were hit, as well as the time the driver had to react. If the victim was in a pedestrian lane, crosswalk, parking lot, cycling lane, or other high-foot-traffic areas, then the driver of the car would probably be faulted for the accident. On the other hand, even if the victim was not in any of these designated foot-traffic areas, the driver may still be at fault if they saw the victim in the road and failed to react. Just because a driver has the right-of-way, doesn’t mean that they have the legal right to hit anybody with their car.

I was actually a couple cars back from this wreck, one of the first on the scene, and helped administer CPR on the victims. The truck driver was going way too fast, but it was actually his trailer that swung around and hit the suv, the semi-truck ended in the median.

At the company that I work for, e deal with monitoring construction activity and work around trenches and all sorts of construction equipment/vehicles. I sometimes wonder if construction companies have enough safety training to inform employees of how to protect themselves while on the job.
