One Injured in School Bus Accident at Ninth and Gay in Longmont, Colorado


LONGMONT, CO — One person was seriously hurt after an accident between an SUV and a St Vrain Valley School bus in Longmont, Colorado on Wednesday, January 7th, 2014. The news reports said that the accident happened around 8:00 Wednesday morning.

One person was taken to the hospital after the Mitsubishi SUV they were driving and a school bus collided near the intersection of Ninth and Gay. Police believe that the bus driver struck the rear of the SUV that was stopped.

The driver of the SUV sustained unspecified injuries in the accident. Nobody on the bus was immediately hurt.

The bus driver was cited for careless driving following the accident.

Local police handled the accident investigation.

Commentary:

Some people may take a look at an accident like this, where a school bus driver is cited following an injury and automatically assume that the citation equates to fault, when in reality, fault and tickets/citations are rarely mutually exclusive. In reality, this citation can be fought and overturned in court, just like you can do if you get a traffic ticket. In reality, because this is a school bus, there is more than likely very limited liability. It should be a surprise to no one that the government has set up quite a complex array of road blocks and red tape to dismantle claims against government agencies before they become a problem, and the victims of accidents really need to be aware of this should they ever be in an accident with a city or state vehicle.

I was actually a couple cars back from this wreck, one of the first on the scene, and helped administer CPR on the victims. The truck driver was going way too fast, but it was actually his trailer that swung around and hit the suv, the semi-truck ended in the median.
