Commentary:
How fast was the car that crossed over going exactly? If the vehicle both lost control, and had enough force to tear the front of the vehicle off then something in my gut tells me they may have been going too fast. If the driver of the car was in fact speeding when he lost control, I can’t envision too many reasons why they wouldn’t be faulted for the accident, but I’d need more information to know for sure.
