Commentary
Liability in an accident isn’t going to be very hard to determine. If a driver isn’t paying attention to the road in front of them and they crash into another vehicle, they’re responsible, and should be held accountable. However, despite the fact that many of these accidents seem pretty clear cut, they can quickly become very muddled once insurance carriers become involved. It’s important to remember that even if the police find someone responsible for an accident, they are not legally obligated to make things right with anyone they’ve hurt. An insurance company has a legal obligation to defend their clients, and they will, even if they’re at fault for an accident. Don’t forget that an insurance carrier is only going to pay someone when they’re forced to.
