Commentary
Luckily, no injuries were reported in this particular accident. But I think it bears some discussion all the same, because of one small detail that’s been mentioned in a couple of news reports. Reports have said that the accident occurred when the trailer’s load shifted. Often, the loading of a trailer won’t be handled by someone directly employed by the trucking company. Many times, this work is farmed out to third party contractors. If a load shifts while the truck is out on the road, the truck rolls over and someone is injured, whoever was responsible for the loading can be held liable for the accident. In this case, a contractor would be considered a third party, and therefore not covered under the employer/employee workers’ comp agreement. Was a third party involved in this particular accident? We don’t know. But it’s definitely something that needs to be looked into.
