Commentary:
With the vast majority of single-vehicle accidents where a passenger was hurt, strictly from a legal perspective, there is almost always a claim that can be made against the driver. Barring some kind of mechanical problem with the car (in which case a claim could be made against the manufacturer), drivers have a responsibility to their passengers to drive in a manner that will not get them hurt. Any failure to do this could be considered a breach of this duty.
