Commentary:
For the majority of passengers in single-vehicle accidents, from a legal perspective, there is almost always a claim against the driver of the car. Drivers have what is called a duty of care to their passengers to drive in a safe manner that will not get them hurt or killed. Any speeding, driving too fast for conditions, distracted driving, or reckless driving that leads to an accident could be considered a breach of this duty and construed as negligence. Again, it all depends on the finer facts, but just from what the news reports say, the passenger in this accident would probably have a claim against the driver.
