Lee Booker, James Booker Injured in Car Accident on FM 1013 Near Kirbyville, TX


Kirbyville, TX — A car accident involving two vehicles sent two men to the hospital on Thursday, December 11, 2014. The accident took place around 10:00 in the morning, on Farm to Market Road 1013.

Reports say that a vehicle had come to a stop on the eastbound shoulder of 1013. The vehicle then turned into the path of another vehicle headed east. This second vehicle had two individuals inside. They’ve been identified as Lee Booker and James Booker. It’s not clear if the first vehicle was attempting to make a u-turn.

Both Lee and James were taken to Christus Jasper Memorial Hospital. There’s been no update on their condition.

The driver of the first vehicle was identified as Gregory Bills. It’s not clear if Bills was injured in the accident.

One thing some people seem to forget is that if you’re stopped on the shoulder, or coming out of a driveway or parking lot, you always yield the right-of-way to traffic already out on the road. While it doesn’t give those already driving free reign to crash into you, the onus is on you to yield. Unfortunately, even in an accident like this, the victims will be responsible for following up with the insurance claim, as the civil side of accidents always falls to the victims to sort out. Remember that, even if the police find you liable for an accident, that doesn’t legally obligate you to make things right with those you’ve hurt. The police are concerned with the criminal side of things: trying to find out if any laws have been broken, the rest is up to you. Further, even when liability seems to be pretty well-established, in many instances you can still expect a fight, as insurance companies have a legal obligation to defend their clients, should they dispute your version of events. While the aftermath of an accident can be smooth and easy for some, for many the road to recovery can be very bumpy, and people should realize that often, a robust legal strategy will be needed in order to get the compensation you deserve.

I was actually a couple cars back from this wreck, one of the first on the scene, and helped administer CPR on the victims. The truck driver was going way too fast, but it was actually his trailer that swung around and hit the suv, the semi-truck ended in the median.
