Commentary
Liability in accidents like these seems pretty clear cut. However, that should never cause victims to think that all they have to do is file their insurance claim and wait for the at-fault party to take care of things. An insurance carrier will try to deny your claim if they believe it’s in their best interests to do so.
For example, I once saw a case in which a tractor-trailer turned in front of a motorcyclist. The motorcyclist crashed into the back of the truck and died. Police investigated and found the truck at fault, so the victim’s family filed an insurance claim. That should have been the end of it. However, the trucking company conducted their own investigation and found that the motorcyclist was speeding, then used those “findings” to deny the claim.
Will something like this happen every time a claim is filed? Of course not, but victims should keep in mind that the best interests of an insurance carrier are not necessarily their best interests, and plan accordingly.
