Commentary:
There are a lot of reasons crossover vehicle accident happen, but distracted driving is starting to rear its head as a leader of the categories. Fortunately, the technology in proving somebody was on their cell phone at the time of the accident has evolved considerably over the last years. Now, we can look at both the data on the device, as well as what nearby towers it pinged, and when it pinged them. Essentially, given the right circumstances, we can show that a driver was on the phone at the time of the impact. It’s always something to consider when looking at a fact pattern like this one.
