Commentary
There are three predominant reasons accidents like this happen: 1) The driver is driving too fast. 2) The driver is following the vehicle ahead of him too closely, and 3) The driver isn’t paying attention to the road. Whatever the reason for this particular accident, the driver needs to be held responsible, because all too often I’ve seen that it’s the case that this sort of behavior is indicative of a larger problem. Drivers who consistently make bad choices out on the road. Often, those decisions lead to accidents like this.
Those involved in these sorts of accidents should know that regardless, of any police action, they still have the right to file a claim against the driver. Police handle the criminal, and it’s up to victims to handle the civil side. This is especially important when dealing with an insurance carrier, as part of their job is to figure how not to pay you.
