Commentary:
The news report mentioned specifically that the driver of the truck was cited for failure to yield following the accident. Many people would hear this and assume that the citation is going to yield them an automatic victory when dealing with the trucking company’s insurance, when in reality, there is no such thing as an automatic win when it comes to dealing with trucking companies. This is an industry that is conditioned to fight every claim against them tooth and nail, no matter how at fault they appear to be. They honestly believe that every claim against them is asking for more than what is deserved (when damages have to be proven in court). People need to really understand that while having a truck driver cited after an accident doesn’t harm the case by any means, it is no surefire bet. Always expect a fight. Always.
