SAN ANTONIO, TX — Two people were seriously hurt after a car accident that happened in northwest San Antonio on Friday, November 14th, 2014. The article released by KSAT said that the crash happened around 11:30 Friday night.
San Antonio Police believe that two people were hurt when the car they were in crashed near the intersection of Babcock Road and Callaghan Road. Authorities say that the car was seen speeding before it hit a curb and rolled.
Both occupants in the vehicle had to be cut free before being taken by EMS to a nearby hospital where they were both listed in critical condition.
The investigation into the accident is ongoing at this time.

Looking at this accident strictly from a legal perspective, if the car was speeding, what fault with the passenger in the car bear? Well, unless they reached over the center console and grabbed a hold of the wheel, then probably none. When a driver elects to take on a passenger, they enter into an understood, unspoken contract with the passenger that says they will not drive in a manner that will get them hurt. If the driver was speeding for whatever reason and crashed the car, the driver of the car has more than likely breached the contract with the passenger. Unless there is some massive detail missing or omitted from the news reports, the driver of the car is probably going to be liable for the accident.
