UPDATE: Paul Szemborski Killed in Motorcycle Accident with Cow in Newton County, Texas


NEWTON COUNTY, TX — Paul Szemborski was killed in a serious motorcycle accident that happened in Newtown County, Texas on Saturday, November 8th, 2014. The article from KJAS said that the accident happened around 7:00 Saturday evening.

45-year-old Paul Szemborski was killed when the motorcycle he was driving crashed on FM 1416. Authorities said the accident happened when the motorcycle struck a cow that was in the roadway.

Szemborski was pronounced dead on the scene by a local Justice of the Peace.

The investigation into the accident is ongoing.

Commentary:

I have a feeling a lot of people are going to be quick to blame the motorcyclist in this accident, but if the victim was in the road, he was exactly where he was supposed to be. The cow, on the other hand, was not supposed to be in the road. Now, a lot of people don’t know that if livestock escapes from the pens or pastures it is supposed to be in before it wanders into a roadway where it causes an accident, the owner of the livestock or the property it escaped from could be held liable for the accident. These animals are large, and ultimately capable of causing a great deal of havoc on a roadway. If this cow escaped from a farm that failed to keep it cordoned away from dangerous situations, then they need to be held accountable. If you owned a pet tiger that escaped and caused a deadly incident, you’d be held liable, why would a livestock owner be any different?

I was actually a couple cars back from this wreck, one of the first on the scene, and helped administer CPR on the victims. The truck driver was going way too fast, but it was actually his trailer that swung around and hit the suv, the semi-truck ended in the median.

At the company that I work for, e deal with monitoring construction activity and work around trenches and all sorts of construction equipment/vehicles. I sometimes wonder if construction companies have enough safety training to inform employees of how to protect themselves while on the job.
