Kaufman County, TX — A woman was taken to the hospital and a man was arrested after an accident on Highway 34 in Kaufman County, Texas, on Saturday, November 15, 2014. The accident took place around 7:45 in the evening.
According to reports, a man driving a pickup truck was headed south on 34 when he crashed head-on into an SUV. The collision caused the man’s truck to spin off the road, eventually rolling over into a ditch. He crawled from the wreckage and was arrested by police for reasons relating to alcohol use.
Emergency workers were able to remove the woman from her SUV and transport her to East Texas Medical Center. There’s been no update on her condition.
Police are continuing to investigate the accident.

Statistically, drunk driving accidents happen later at night, as that’s when people are leaving bars and heading home. This accident happened a little earlier in the evening, but it’s possible the driver had been out drinking at a bar nonetheless. If that’s the case, it’s possible the bar could be found partially liable for the accident. Texas law says that bars and similar establishments aren’t able to serve customers who are already intoxicated. But what we’ve found in our years of looking at cases like this is that that’s a rule that gets ignored all the time. It wouldn’t be ignored if bars that violated that rule were actually held responsible. A lot of people think this and similar laws only take blame away from the people who are actually committing the crime. That’s not true. The drivers should obviously be held responsible. But if a bar helped push them over the line, and then that person goes out and gets into a wreck, they should also be held accountable.
