Commentary
This accident happened around 8:00 in the evening. While these sorts of accidents typically happen later at night, it’s very possible that the driver was coming home from a bar before the accident occurred. If that’s the case, then it’s possible that the bar could find itself partially liable for what happened. Texas law says that a bar or similar establishment can’t serve a customer alcohol is they’re already intoxicated. It’s a rule that gets ignored all the time. And that sometimes has very big consequences. Punishing the bar in a case like this isn’t meant to take any responsibility away from the driver. They were the one who got behind the wheel, and should be made to account for that. However, if a bar continues to serve a customer and then just pushes them out the door at the end of the night, and then that person goes out and gets into a wreck, the bar has played a role in that. Letting them get away with it would be criminal. Bars would stop over-serving their customers if more bars were held responsible for doing it.
