Commentary:
With any kind of accident that involves a drunk driver, people really need to understand what is going to happen, and how it is going to be investigated. People seem to believe that drunk driving accidents are handled identically to regular car accidents, but with alcohol involved, a crime has to be investigated. First of all, the offending driver, if guilty, will be handled and punished by the state. However, what if the driver came from a bar before the accident, and what if that bar broke the law too? What do I mean? Well, believe it or not, driving drunk and over-serving a customer alcohol at a bar are equally illegal, but how does the state throw a bar in jail after an accident like this? Short answer, they really can’t. They may be fined, but does that fine go to the family? Absolutely not. It goes into government coffers, but the state was smart enough to give citizens the power to hold a bar liable in civil court. A lot of people are shocked to hear it, but these cases have been won before.
