Commentary:

Now, there are a lot of details to consider when you’re talking about a pedestrian accident. While there is a chance that the victim in this accident bolted suddenly into the road and there was nothing that the driver could have done to avoid the accident, the fact that this accident took place on Halloween night at the sunset hours makes me wonder why the driver of this car wasn’t keeping a watchful eye out. Halloween is the banner day for children dotting neighborhoods everywhere. While driving in a residential area any other day, drivers need to be watchful of kids chasing after balls or riding scooters in the street. This kind of anticipatory vigilance needs to be amplified to the highest degree on a day whose traditions revolve around kids walking in neighborhoods. Whenever you are driving to an event at an arena or a sporting venue where lots of pedestrians are funneling from parking lots to the venue, do you navigate the parking lots at the posted speed limits, or should you slow down to accommodate the foot traffic? Should this driver have had a similar attitude?

I'm a former employee. I had brought up this exact scenario and suggested a maintenance procedure that would eliminate the possibility of this type injury. Obviously my warning went unheeded.

I was actually a couple cars back from this wreck, one of the first on the scene, and helped administer CPR on the victims. The truck driver was going way too fast, but it was actually his trailer that swung around and hit the suv, the semi-truck ended in the median.

A lot of people say smack about lawyers, but I want to say that I'm glad there is a way that people who are wronged by corporate neglect can get justice and force change. We are living in a world where corporations and govt care less than ever about common people, and I support your work. I hope I will never need your services.

Thank you for posting these accident articles on your site. At the company that I work for, e deal with monitoring construction activity and work around trenches and all sorts of construction equipment/vehicles. I sometimes wonder if construction companies have enough safety training to inform employees of how to protect themselves while on the job.
