NEWARK, DE — A child was taken to the hospital after a tractor-trailer accident that happened in Newark, Delaware on Wednesday, October 15th, 2014. The news article from Delaware Online said that the accident happened around 9:30 Wednesday morning.
State Police said that an unidentified 3-year-old girl was taken to the hospital after the Honda van she was in was hit by a tractor-trailer in the southbound lanes of Interstate 95. Authorities said that the tractor-trailer hit the back of the van that had slowed for traffic.
The girl was taken to Nemours/A.I. Dupont Hospital where she was being treated for unspecified injuries.
No other injuries were detailed in the accident. The Delaware State Police are helping out with the accident investigation.

Just from a legal perspective, I can’t see too many reasons that the driver of the tractor-trailer in this collision wouldn’t be faulted. The news said that the minivan had slowed for traffic when it was hit from behind. Why did the truck driver not see the van, nor the traffic it was slowing for from its high vantage point? I’m wondering what a private investigation would show. Was the trucker dazed out or did she nod off after driving too many hours? Was she checking her cell phone? Believe or not, these kinds of things leave plenty of evidence behind, and there could be plenty of recorded data in the truck’s telemetry computer, as well as timestamps on text messages and other clues that could tell us what happened. Bear in mind though, that this evidence has a way of evaporating as time elapses, so moving swiftly is always the best way to preserve a victim’s legal rights in cases like this.
