Commentary:
Alcohol related accidents are not handled the same as regular accidents are, as many seem to think. Why? Because when you’re dealing with a drunk driving accident, you’re investigating a crime, and sometimes, more than one crime. Drivers know it is illegal to get behind the wheel of a car when they’re drunk because they know it has a high probability of causing an accident. Do you happen to know what else is illegal that has a high probability of causing an accident? Bars and licensed liquor sellers over-serving their customers. Most of us have been at a bar or restaurant where we were encouraged to stay for one more round of drinks, but bartenders and servers know that they have a legal obligation to cut you off, not encourage you to drink more. If a drunk driver decided to take the risk of causing an accident when they got behind the wheel, shouldn’t the bar that fueled them be punished for taking an identical risk?
