Commentary:
We have virtually no concrete details about the accident, but in my experience tractor-trailers and commercial vehicles in general fall into disrepair all the time. Necessary repairs or replacement on things like tires and brakes fall by the wayside either intentionally to save a buck, or simply out of carelessness. Wouldn’t it be prudent to explore these possibilities before we dump the accident into the lap of the driver. Sure, it is possible that the accident was caused by the victim, but that is by no means the only possibility.
