Debra Settlemyer Critically Injured in Box Truck Accident on Route 40 in Elkton, MD


Elkton, MD — Police say that Debra Settlemyer was taken to the University of Maryland’s Shock Trauma Unit in Baltimore after her car was hit by a box truck in Elkton, Maryland.

Witnesses told  police that Settlemyer had a green light when she drove through the intersection at Route 40 and Route 7. As she came into the intersection, she was hit by a box truck being driven by Victor Diaz. The accident happened on Sunday, September 21, 2014, just before 8:00 in the morning.

Officials say that Settlemyer is still in critical condition, although it’s been two days since the last update on her condition.

Diaz was taken to Union Hospital in Elkton. He had suffered minor injuries and was treated and released.

There hasn’t been any word on possible charges being brought against Diaz.

I’d imagine that the biggest question on this woman’s mind is whether or not the trucking company or individual responsible for this accident is going to be liable for her injuries. The answer is yes. If they’re responsible for her injuries, they’re going to need to make things right. The important thing to remember after an accident like this, however, is that if it was a company that owned the truck that hit her, they’re not very likely to take things lying down. In these situations, they always fight back.

I think another thing to keep in mind is the behavior on the part of the truck driver. He ran a red light. That’s upsetting for a number of reasons, one of the biggest of which is that he presumably drives for a living and shouldn’t be making mistakes like this. If he wasn’t paying enough attention to keep from blowing through a red light at an intersection, what else is he not paying attention to? If the driver were to undergo any sort of investigation, what else would the investigators find?

I was actually a couple cars back from this wreck, one of the first on the scene, and helped administer CPR on the victims. The truck driver was going way too fast, but it was actually his trailer that swung around and hit the suv, the semi-truck ended in the median.
