Commentary

From the sound of things, it seems as if the accident was caused because the driver of the 18-wheeler wasn’t paying close enough attention to the road. If that turns out to be the case, then he — and, by extension, the company he works for — would be liable for the accident. Unfortunately, these kinds of accidents are never that simple. In an accident like this, it’s almost guaranteed that a trucking company is going to put up a fight, whether they’re in the wrong or not. They have a lot of money invested in things. Their truck, their driver. They’re required to carry large insurance policies on their trucks. All of these things affect their bottom line, so that’s what they’re going to defend.

Of course, people might look at this relatively minor accident and say, well, the driver of the second truck only sustained minor injuries. But it’s important to remember that what may seem like a minor injury today may not be a minor injury six months from now. Things like nerve and muscle damage need to be looked at by professionals before we can really know their true extent.

I'm a former employee. I had brought up this exact scenario and suggested a maintenance procedure that would eliminate the possibility of this type injury. Obviously my warning went unheeded.

I was actually a couple cars back from this wreck, one of the first on the scene, and helped administer CPR on the victims. The truck driver was going way too fast, but it was actually his trailer that swung around and hit the suv, the semi-truck ended in the median.

A lot of people say smack about lawyers, but I want to say that I'm glad there is a way that people who are wronged by corporate neglect can get justice and force change. We are living in a world where corporations and govt care less than ever about common people, and I support your work. I hope I will never need your services.

Thank you for posting these accident articles on your site. At the company that I work for, e deal with monitoring construction activity and work around trenches and all sorts of construction equipment/vehicles. I sometimes wonder if construction companies have enough safety training to inform employees of how to protect themselves while on the job.
