Commentary:
There are a few facts that lead me to believe alcohol played a significant role in this accident. The first thing that needs to be looked at is the time that the accident took place. The fact that the accident happened at or around the 2:00 a.m. last call closing time for bars on a weekend night/morning tells us one thing, and the fact that the accused driver allegedly fled after the accident tells us another. Together, it doesn’t take a big leap of faith to see that the driver may have come from a bar before the accident, and fled the scene because he was aware of his intoxication. At this point, finding out where the accused drunk driver consumed alcohol needs to be the next order of business. If the offending driver was at any licensed liquor selling establishment where he was over-served, then the business that served him needs to be punished right along side the drunk driver. I’ve said it before, and I’ll say it again, the moment bars and liquor stores are held liable for drunk driving accidents is when they will begin to see drunk drivers as a liability.
